On March 30, 2021 the Honorable Judge Alicia Kersey sentenced Timothy McCarter to 72-months in the care, custody and control of the Oregon Department of Corrections for his role in the death of Wildon Chadwell, and his plea of guilty to one count of Criminally Negligent Homicide.
The incident occurred on August 3, 2019, when the Defendant and Mr. Chadwell argued. During the argument with Mr. Chadwell, Mr. McCarter was armed with a large edged-weapon, described by at least one witness as a sword. The argument between Mr. Chadwell and Mr. McCarter escalated and Mr. Chadwell was negligently struck with the weapon. Mr. Chadwell died as a result of the injuries he suffered. Klamath County Deputy District Attorney Cole Chase prosecuted this difficult matter. As District Attorney I extend gratitude to law enforcement for working so closely with our office to resolve this and many other matters.
